MINUTE ORDER (TEXT Only): In an email sent on November 7, 2018, Plaintiffs' counsel asks the Court to stay its prior minute order requiring Plaintiffs to file an amended complaint naming the absent heirs by December 7, 2018. Because the Court's minute order addressing the need for an "amended complaint or a motion to compel joinder" was not entirely clear on the matter, the Court provides the following clarification and additional guidance. Federal courts have generally held that in wrongful death cases, absent heirs are considered "necessary" parties. See McMurray v. County of Sacramento, 2012 U.S. Dist. LEXIS 11501, *8-*9 (E.D. Cal. Jan. 31, 2012); Ruttenberg v. Ruttenberg, 53 Cal.App.4th 801, 807-808, 62 Cal. Rptr. 2d 78 (1997) (an heir who brings a wrongful death claim has "a mandatory duty to join all known omitted heirs in a 'single action.'"). For that reason, the existing parties must attempt to resolve the issue of the absent heirseither through a release of claims; an amended complaint; a motion to compel joinder; the Court's informal resolution process; or any other motion or briefing the parties deem appropriate by December 7, 2018. The parties should meet and confer to determine what procedure is required and file the appropriate pleading, opening brief, or motion, if necessary, no later than December 7, 2018. See Pavoni v. Chrysler Grp. LLC, No. CV 11-10513 RGK (SPx), 2012 WL 12883905, at *2 (C.D. Cal. Nov. 15, 2012) (holding that two children of decedent who had elected not to participate in a wrongful death lawsuit must still be joined as nominal defendants or "involuntary plaintiffs"); Estate of Burkhart v. United States, No. C 075467 PJH, 2008 WL 4067429, at *7 (N.D. Cal. Aug. 26, 2008) ("An heir who files a wrongful death action is required to properly join all known heirs in the action."); but cf Backer v. United States, 2014 U.S. Dist. LEXIS 121386, 2014 WL 4267500, * 3 (E.D. Cal. Aug. 29, 2014) (holding that where an absent heir's claims are time-barred, the absent heir is not indispensable). MINUTE ORDER (TEXT Only): Prior to setting second amended scheduling conference dates, the parties raised several unresolved issues related to the procedural posture of this case including: (1) the appointment of a guardian ad litem for Plaintiff's minor children pursuant to L.R. 202(a) and FRCP 17(c); (2) whether the decedent's adult heirs, not currently named as Plaintiffs, are necessary parties; and (3) the scope of discovery for the new and existing parties. The Court sets the following briefing schedule for the petition for appointment of guardian ad litem: petition due November 16, 2018; opposition, or statement of non-opposition due: November 30, 2018; reply, if any, due: December 7, 2018. The matter will stand submitted once the briefing is on file. Before the parties pursue an amended complaint or a motion to compel joinder, Plaintiffs and counsel for Dr. Sanchez agreed to attempt to secure a release of all claims from the decedents adult children. If unsuccessful, Plaintiffs shall file their amended complaint adding the heirs as nominal defendants on or before December 7, 2018. With respect to the scope of discovery, the Court does not anticipate allowing the formerly existing parties to take additional depositions beyond the deposition of Dr. Sanchez. However, if needed, the parties may agree to additional depositions by stipulation. If the parties are unable to reach an agreement, the parties shall use the Court's informal discovery process as explained during the scheduling conference and detailed in the judge's standard procedures available on the Courts website.
