On 1/10/2020, defendant Ulta, Inc. removed this action to this federal court on the basis of diversity of citizenship pursuant to 28 U.S.C. 1332, asserting that Plaintiff is a citizen of California, defendant Ulta, Inc. is a citizen of Delaware, and defendant Jackson is a citizen of Connecticut. Plaintiff's complaint alleged that defendant Jackson was a citizen of California. In asserting that diversity jurisdiction exists, defendant Ulta states that after plaintiff filed a request for default as to defendant Jackson, defendant Ulta learned "for the first time that defendant Jackson... was domiciled as of the date of the original filing of the [state court] action[] in Connecticut." (Doc. No. #1 at 5.) Defendant Ulta points the court to declarations from its counsel and one of its employees in support of its assertion, but the court is unable to determine from those declarations alone that at the time of the filing of the complaint in state court, defendant Jackson was domiciled in Connecticut. Accordingly, by Tuesday, January 21, 2020 at 12:00 p.m., the parties are directed to provide the court with additional information about where defendant Jackson was domiciled at the time plaintiff filed the complaint and whether this court has jurisdiction based on complete diversity of citizenship. Each party may file its own brief or the parties may file jointly. (Thorp, J) |
