July 8, 2022 Opinion or Order Filing 12 MINUTE ORDER signed by District Judge Dale A. Drozd on 7/8/2022: (Text Only Entry) On June 7, 2022, the court issued a #6 temporary restraining order in this action and directed plaintiff to submit a status report to the court with respect to any motion for preliminary injunction within fourteen (14) days of the entry of that #6 order. On July 7, 2022, plaintiff submitted a #11 status report to the court seeking a 14-day extension of the expired #6 temporary restraining order because she "has not yet culled sufficient documents and information to identify" the Doe defendant. (Doc. No. 11 at 3.) However, under Fed. R. Civ. P. 65(b)(2), a temporary restraining order expires "at the time after entry... that the court sets, unless before that time the court, for good cause, extends it for a like period or the adverse party consents to a longer extension." (emphasis added). The #6 temporary restraining order in this action expired on June 21, 2022 and thus may no longer be extended in accordance with Fed. R. Civ. P. 65(b)(2). Accordingly, plaintiff's request for an extension of the #6 temporary restraining order is DENIED. To the extent that plaintiff requests leave to file an amended complaint pursuant to her #11 status report, her request is GRANTED. A first amended complaint in this action, if any, must be filed no later than twenty-one (21) days from the entry of this order. Finally, plaintiff is directed to submit a status report to the court with respect to any anticipated motion for a preliminary injunction no later than twenty-one (21) days from the entry of this order.(Hernandez, M)
