Meza filed a #18 stipulation regarding Plaintiff's fees, costs, and expenses, and a request for entry of order. The Court intends to issue an order addressing the parties' #17 offer of judgment under Rule 68 within a month. In the #18 stipulation, the parties stipulate to Defendant paying $9,000.00 to resolve Plaintiff's attorneys' fees, costs, and expenses within 60 days of execution of the Court's order granting the parties' #18 stipulation. (ECF No. 18 at 1.) In Defendant's #17 offer of judgment, "[Defendant] offers to pay reasonable costs, expenses, and attorneys' fees pursuant to a properly noticed motion pursuant to Civil Code Section 1794(d)." (ECF No. 17 at 5.) The #17 offer of judgment further provides that, "Plaintiff[] shall not recover post-offer costs, including attorneys' fees from the date of this Statutory Offer." (Id.) It does not, however, list how many hours each attorney billed up to service of the offer of judgment and at what rate did each attorney charge per hour. Furthermore, the stipulation lacks any records of other costs and expenses affiliated with the instant matter that would be covered by the #18 stipulation. Without this information, the Court cannot determine whether Plaintiff is being awarded reasonable attorneys' fees and costs pursuant to the #18 stipulation. See Hensley v. Eckerhart, 461 U.S. 424, 433 (1983). Therefore, the Court DENIES the #18 stipulation without prejudice, and if Plaintiff still wishes to recover fees, costs, and expenses, the Court directs the parties to re-file their stipulation with the aforementioned missing information by no later than Friday, April 28, 2023.
