Filing 9 MINUTE ORDER (Text Only Entry) Considering the entire record, including, but not limited to, the fact that the state court from which this case was removed entered an ex parte TRO and the timing of the removal relative to the TRO expiration, the Court is strongly inclined to grant the pending request to extend the TRO (Doc. #6 ). Nonetheless, the Court will entertain any opposition to that request if filed by midnight TODAY, Friday April 7, 2023. The parties are warned, however, that, in the Court's preliminary reading of Fed. R. Civ. P. 65 and the relevant caselaw, it is only permitted to extend the TRO by fourteen days. The Court is not inclined to let that limitation prejudice the Plaintiff, so, if the TRO extension is granted, the Court will advance a hearing date on the preliminary injunction motion (and possibly any related motion to remand) to April 24, 2023, and accelerate all deadlines accordingly. Alternatively, the parties may reconsider a stipulation to extend the TRO up to and through a later hearing date that will afford the Court and the parties a reasonable amount of time to consider the matter. Given the potentially complex jurisdictional issues that may arise, the Court encourages the parties to consider seriously the latter signed by District Judge Jennifer L. Thurston on April 7, 2023. (Munoz, I) |
