The Clerk is FURTHER DIRECTED to re-file the 53 MOTION for issuance of Lis Pendens in the new action. Within 30 days of the date of this order, Howard Herships and Karen Fletcher shall file an Application for In Forma Pauperis or pay the $400 filing fee in the new case.
