January 19, 2007 Opinion or Order Filing 2 ORDER AND FINDINGS AND RECOMMENDATIONS in Case No. 2:04cv2309-LKK-KJM signed by Judge Kimberly Mueller on 1/18/07 ORDERING that 25 motion for severance filed by dfts Lane, Godman, Mitchell, Anderson, Tillman and Burgess is GRANTED. This action wil l proceed on Claim I in pltf's complaint against dfts Harris-White, Cooper and Steber. The Clerk is directed to open two new files assigned to the same judges as in this action. In one action, the dfts will be Godman and Tillman and will proceed on claim II. In the other, the dfts will be Mitchell, Anderson and Burgess and will proceed on claim III. The Clerk shall file a copy of pltf's complaint in each of the new cases along with a copy of this order. It is RECOMMENDED that 25 moti on by dfts Lane, Godman, Mitchell, Anderson, Tillman and Burgess that claims II and III found in pltf's complaint is stayed, be granted. Motion referred to Judge Karlton. Objections to the findings shall be filed and served within 20 days after being served with findings.
