ORDER signed by Magistrate Judge Kevin S. Chang on 1/5/09 ORDERING that plaintiff's 15 request for leave to proceed in forma pauperis is GRANTED. Plaintiff is obligated to pay the statutory filing fee of $350 of this action. James D. Ha rtley, Warden Avenal State Prison, or his designee, shall collect from plaintiff's prison account monthly payments in an amount equal to twenty percent of the preceding month's income credited to plaintiff's prison account and shall fo rward those payments tothe Clerk each time the amount in the account exceeds $10 in accordance with 28 U.S.C. 1915(b) (2) until a total of $350 has been collected and forwarded to the Clerk. The Clerk of the Court is DIRECTED to serve a copy of this Order on Plaintiff and on James D. Hartley.
