ORDER signed by Magistrate Judge Barry M. Kurren on 1/6/09 ORDERING that Plaintiff's 4 request for leave to proceed in forma pauperis is GRANTED. Plaintiff is assessed an initial partial filing fee of $20. Plaintiff is obligated to pa y the statutory filing fee of $350 for this action. Mike McDonald, Warden, at High Desert State Prison, or his designee, shall collect from Plaintiff's prison account monthly payments in an amount equal to twenty percent of the preceding mo nth's income credited to Plaintiff's prison account the initial partial filing fee and thereafter, monthly payments in an amount equal to 20% of the preceding month's income credited to plt's prison account and shall forward those payments to the Clerk of Court each time the amount in the account exceeds $10 in accordance with 28 U.S.C. 1915(b)(2) until a total of $350 has been collected and forwarded to the Clerk of Court. The Clerk of the Court is DIRECTED to serve a copy of this Order on Plaintiff and on John Marshall.
