ORDER signed by Magistrate Judge Dale A. Drozd on 10/23/10 ORDERING that the Motion to Quash service filed by defendants Tim McArdle, Bonnie Garcia, and George Plescia 13 is GRANTED. Plaintiff's attempted service of process prior to issuance o f a summons is quashed as to each defendant upon whom Plaintiff's attemped to serve their complaint. After this order is served on counsel for the three specially appearing defendatns, the Clerk shall modify the docket to reflect that no defenda nt has appeared in this action. Within 30 days after this order is signed, plaintiff Cy Provencher Sr. shall complete and file an application to proceed in forma pauperis.
