January 16, 2013 Opinion or Order Filing 58 ORDER signed by Magistrate Judge Kendall J. Newman on 1/16/2013. Mr. Shevchenko's 57 Notice Of Dismissal [FRCP Rule 41(a)] is defective and does not effectuate dismissal of action without prejudice, nor does it effectuate dismissal of Mr. She vchenko individually.
