The action was dismissed on January 17, 2013, all motions for reconsideration have been considered and decided, and plaintiff has appealed to the Ninth Circuit Court of Appeals. Pending before the court is plaintiff's motion (Doc. 19) for leave to proceed in forma pauperis on appeal. That motion is denied without prejudice to renewal in the appellate court. Mueller on 5/13/2013 ORDERING that Plaintiff's 12 and 13 motions are DENIED as plaintiff was informed the court will not entertain any further motions for reconsideration. The 6/14/2013 hearing date on plai ntiff's two motions is hereby VACATED. However, the court will amend a typo in its April 24 order. The court referred to plaintiff as a "state prisoner proceeding pro se." (ECF 11 at 1.) Plaintiff is a pro-se litigant but he is not a state prisoner. This typo did not factor into the court's analysis and plaintiff has not argued he suffered any prejudice from it. Accordingly, the court STRIKES the words "state prisoner" from its prior 11 order. Plaintiff is again admonished the court will not entertain any further motions in this case, and no further orders will issue. (Zignago, K.) |
