Moreover, their allegations that these provisions directly regulate interstate commerce fail as a matter of law. Plaintiffs do, however, adequately allege that Sections 19858 and 19858.5 indirectly regulate interstate commerce. To the extent that Plaintiffs' dormant commerce c laims rests upon this theory of liability, the Court DENIES 50 Motion to Dismiss.
