January 10, 2018 Filing 14 MINUTE ORDER: Defendant moved to compel arbitration. ECF No. 8. Plaintiff filed an opposition and Defendant filed a reply. ECF Nos. 11, 12. Plaintiff subsequently filed a notice of partial non-opposition to Defendants motion if the Court includes language in its Order compelling arbitration that will prevent Flexcare from arguing in arbitration that the agreement prohibits Junkersfeld from arbitrating her claims on a class basis. ECF No.13. In light of this filing, the Court is willing to vacate the January 16, 2018 hearing if Defendant stipulates to Plaintiffs request. The parties are ORDERED to submit a stipulation and proposed order by noon on January 12, 2018. The Court also ORDERS Defendant to pay $250.00 in monetary sanctions for filing a ten page reply. As stated in the Order re Filing Requirements on October 5, 2017, reply memoranda are limited to five pages and violating the order will result in monetary sanctions being imposed against counsel in the amount of $50.00 per page and the Court will not consider any arguments made past the page limit.
