June 11, 2020 Filing 10 MINUTES for Video Scheduling Conference held before Chief District Judge Kimberly J. Mueller on 6/11/2020, and FRCP 16 BENCH ORDER: Plaintiff's Counsel, Nina Wasow and Andrea Obando, present. Defendant's Counsel, Warren Hodges, present. The court and counsel discussed case scheduling. After careful consideration of the parties' comments and confirming that initial disclosures as required by Federal Rule of Civil Procedure 26(a) have been completed, the court ORDERED the following pre-trial case schedule: Plaintiff may seek leave to file an amended complaint though 1/30/2021; fact discovery shall be completed by 2/26/2021; expert disclosures shall be completed by 4/2/2021; rebuttal expert witnesses shall be exchanged by 4/23/2021; all expert discovery shall be completed by 5/21/2022; and all dispositive motions, except for motions for continuances, temporary restraining orders or other emergency applications, shall be heard by 6/21/2021. After consideration of the parties' comments related to settlement, the court declined to set a settlement conference; however, the parties were directed to notify the court whether a court settlement conference date or referral to the Voluntary Dispute Resolution Program "VDRP" becomes reasonable. The parties shall file said notification or request for referral jointly, in writing. In light of the parties' representation that they do not anticipate the need for experts, they shall meet and confer regarding experts, at the conclusion of fact discovery, and file a stipulation and proposed order to advance the dispositive motion deadline, or the setting of a Final Pretrial Conference if appropriate. This case schedule will become final without further order of the court unless objections are filed within fourteen (14) calendar days of this order. The schedule, once final, shall not be modified except by leave of court upon showing of good cause.
