July 2, 2021 Filing 13 MINUTE ORDER: On March 30, 2021, Defendant Resource Staffing Group, Inc., filed a Motion to Dismiss the action denominated 2:21-cv-00538-JAM-JDP (Coe II) or in the alternative to consolidate said action with the present action (Coe I). See Mot., ECF No. 7 (Coe II). Plaintiff filed an opposition. Opp'n, ECF No. 17 (Coe II). Defendant replied. See Reply, ECF No. 18 (Coe II). District courts retain broad discretion to control their dockets and "[i]n the exercise of that power" they may "dismiss a duplicative later-filed action, to stay that action pending resolution of the previously filed action, to enjoin the parties from proceeding with it, or to consolidate both actions." Adams v. Cal. Dept of Health Servs., 487 F.3d 684, 688 (9th Cir. 2007) (internal citations omitted). Here both parties agree that under Adams, this Court may consolidate Coe I and Coe II. Mot. at 7 (Coe II); Opp'n at 17 (Coe II). Because the two actions involve the same parties and the same nucleus of operative facts, the Court finds that consolidation is appropriate. Indeed, Plaintiff has previously stipulated that the two actions are related and "make essentially the same factual allegations and asserts the same legal theories in both cases." See Joint Status Report, ECF No. #7 , Ex. 3 to Def.'s RFJN at 3-4, 7, ECF No. #2 . Accordingly, the two actions are consolidated, and the parties shall use case number 2:20-cv-00585-JAM-JDP on all future pleadings. Plaintiff shall file an amended complaint consolidating his claims within twenty days (20) of this Order. Defendants' responsive pleading is due twenty days thereafter. IT IS SO ORDERED.
