Mueller: Having considered the parties' argument and reviewed relevant authority, including Morlife, Inc. v. Perry, 56 Cal. App. 4th 1514 (1997) and Pollara v. Radiant Logistics Inc., No. CV 12-344 GAF (JEMX), 2014 WL 12584445 (C.D. Cal. Aug. 5, 2014), aff'd, 650 F. App'x 372 (9th Cir. 2016), the court confirms its FINDING that the evidence of record meets plaintiff's burden at this stage of showing defendants have misappropriated plaintiff's trade secrets, including the component of plaintiff's trade secrets identified as an "extensive curated list of direct contact information for doctors." See Compl. at paragraphs 12, 89. The record does not dispel the reasonable inference that defendants, given the roles they played while still employed by plaintiff, cannot conduct business with any entity identified on the curated list without using or disclosing plaintiff's trade secrets as fully identified in the complaint and in the briefing. Therefore the current circumstances justify leaving the Temporary Restraining Order (TRO) previously entered, ECF No. #17 , in full force and effect for a brief period of time pending supplemental briefing based on the expedited discovery currently being completed, Morlife, 56 Cal. App. 4th at 1528-29, while clarifying that the TRO does not prevent defendants from lawfully announcing their new employment as long as any announcement does not make use of plaintiff's trade secrets. The parties may simultaneously file supplemental briefing of up to 10 pages each, not including excerpts of the discovery record, by May 29, 2020 at noon. In the event the court confirms it will hear argument after receiving the briefing, it sets a Non-Evidentiary Videoconference Hearing of the matter for Wednesday, June 3, 2020 at 10:00 AM.
