Though not entirely clear, it appears that the parties no longer intend to list joint exhibits. (See Doc. No. #68 at 5 (plaintiffs stating that their 18 exhibits are listed in the attachment); (Doc. No. #70 at 4 (defendants stating that "[u]nfortunately, due to a sudden illness of defense counsel, it became impossible to submit a joint list" and that exhibits 1-18 "are submitted by plaintiffs")). Nevertheless, the updated list submitted by defendants in connection with their #70 objections, purporting to be a list of defendants' exhibits, fails to provide a clear list of exhibits, fails to properly list exhibits using alphabetic designations as directed in the tentative pretrial order, and fails to avoid duplicate exhibits. For example, plaintiff lists as exhibit No. 18 "Defendant Kenton Kiaser's flight records" with Bates-stamp 00103-112, and defendants designate both "DEF Kenton Kiaser's flight log books, 00103-00111" and "DEF-44 Flight logbook records of Kenton Kiaser 00103-00112" as separate exhibits. Accordingly, the parties are directed to meet and confer, and by no later than 12:00 p.m. on 4/12/2023, the parties shall file a joint submission to provide: (i) an updated list of joint exhibits, if any, or a statement that there are no joint exhibits; (ii) a separate list of plaintiff's exhibits, designated numerically; and (iii) a separate list of defendants' exhibits, designated alphabetically.
