Filing 10 MINUTE ORDER issued by Courtroom Deputy J. Streeter for Magistrate Judge Carolyn K. Delaney on 01/21/2021: On December 1, 2020, the court denied plaintiff's application to proceed in forma pauperis without prejudice. (ECF No. #4 .) On December 11, 2020, plaintiff filed a renewed application to proceed in forma pauperis that cured the deficiencies of the first. Before the court ruled on plaintiff's renewed application, defendants filed a motion to dismiss the original complaint, which is set for hearing on January 27, 2021. (ECF No. #8 .) To date, plaintiff has not opposed or otherwise responded to the motion to dismiss. Accordingly, plaintiff's renewed application to proceed in forma pauperis (ECF No. 7) is GRANTED. In addition, the January 27, 2021 hearing on defendants' motion to dismiss is continued to February 17, 2021 at 10:00 AM. Plaintiff shall file either an opposition or a statement of non-opposition to defendants' motion no later than February 3, 2021. Defendants shall file a reply, if any, no later than February 10, 2021. Plaintiff is advised that the failure to file a timely opposition to defendants' motion may be construed by the court as a non-opposition to the motion and may result in a recommendation that this action be dismissed.
