August 1, 2022 Filing 9 MINUTE ORDER issued by Courtroom Deputy for Chief Magistrate Judge Kendall J. Newman on 8/1/2022: This action was assigned to the undersigned Magistrate Judge under the court's automated case assignment plan. See Local Rules, Appendix A, subsection (m). (See ECF No. #3 .) The court is in receipt of the parties' stipulation and proposed order to further extend the time for defendant USLI to respond to the complaint and to set a stipulated briefing schedule and hearing date for USLI's contemplated motion to dismiss. (ECF No. #8 .) While the court is amenable to the proposed schedule in substance, the court declines to adopt the proposed order until all parties make a Consent/Decline election. Each party's decision whether to consent or decline magistrate judge jurisdiction for all purposes under 28 U.S.C. 636(c) will dictate whether this case remains before the undersigned or is reassigned to a district judge as presiding judge. As noted in the Initial Scheduling Order (ECF No. #3 , para. 2), the court is disinclined to hear motions until all consent/decline designations have been submitted. There is no obligation to consent, and no judge will be notified of a party's decision unless all parties have consented. See Fed. R. Civ. P. 73(b)(1). Still, for proper case administration, there is an obligation for each party to inform the court of their decision whether or not to consent to magistrate judge jurisdiction for all purposes. Should any party decline magistrate judge jurisdiction, the case would be reassigned to a random district judge as presiding judge, and the contemplated motion to dismiss (and any tailored scheduling of that motion) would be managed by that district judge instead of the undersigned.
