Mendez on 02/28/2023:On 01/30/2023, the Court issued an Order ("Order") that dismissed Defendant Kim Johnson ("Johnson") in her official capacity from Plaintiffs' first amended complaint with prejudice. See Order, ECF No. #37 . Thereafter, Plaintiff filed a second amended complaint ("SAC") naming Johnson as a defendant individually. See Second Am. Compl., ECF No. #38 . On 02/23/2023, Johnson filed a motion for clarification ("motion") regarding the Order, asking the court to: (1) specify whether Plaintiffs can sue Johnson in her individual capacity; and (2) grant a 30-day extension on Johnson's responsive pleading if Plaintiffs can sue her individually. See Mot. for Clarification at 2, ECF No. #39 . Thereafter Plaintiffs filed their opposition, asking the Court to deny Johnson's motion. See Opp'n to Mot. for Clarification ("Opp'n"), ECF No. #40 . Plaintiffs argue the Court should reject Johnson's request because the motion is procedurally defective pursuant to Local Rules 144 and 233 and Federal Rules of Civil Procedure 6, 16, and 78. See Id. at 2. Plaintiff also argues Johnson's motion is substantively defective because "no good cause exist [sic] to grant Johnson an additional 30 days to respond to Plaintiffs' SAC." See Id. First, the Court clarifies its Order: Plaintiffs can sue Johnson in her individual capacity in their SAC. Johnson can file a motion to dismiss in response to the SAC if she believes there is a legal basis to do so.Second, the Court finds: (1) FRCP 6, 16, and 78 and Local Rule 233 do not prohibit Johnson's request; (2) Johnson complied with Local Rule 144(c)'s requirements; and (3) Johnson made her request with good cause. The Court therefore GRANTS Johnson's request for a 30-day extension to reply to Plaintiffs' SAC. (York, M) |
