November 17, 2022 Filing 13 MINUTE ORDER issued by Courtroom Deputy for Chief Magistrate Judge Kendall J. Newman on 11/17/2022: Plaintiff filed this case on September 29, 2022, and the case was assigned directly to the undersigned pursuant to Appendix A, sub. (m) of the Local Rules. (See ECF Nos. 1, 5.) To date, defendant Prudential has entered an appearance, and two consent/decline forms have been filed. (See ECF Nos. 11, 12.) However, given that defendant PRIDE has yet to enter an appearance (and the time for plaintiff to serve PRIDE under Rule 4 has not yet expired), and given that defendant Prudential will be required to file a response by November 23 (see ECF No. 9), assignment of a district judge is necessary to facilitate any forthcoming dispositive motions. See Williams v. King, 875 F.3d 500, 504 (9th Cir. 2017) (noting that the consent of all parties (including unserved defendants) is a prerequisite to a magistrate judge's jurisdiction to enter dispositive decisions under 636(c)(1)). Should all parties consent to the jurisdiction of a magistrate judge after defendant PRIDE appears, the case may be reassigned to the undersigned for all purposes. Accordingly, the clerk of the court is now directed to randomly assign a district judge to this action. (Text Only Entry)(Waldrop, A)

October 20, 2022 Filing 10 MINUTE ORDER issued by Courtroom Deputy for Magistrate Judge Kendall J. Newman on 10/20/2022: The parties' Stipulation (ECF No. #9 ) is effective without a court order. As noted on the consent/decline documents issued by the Clerk, the parties are not required to consent, but the parties' designations are required in order for the court to properly process any forthcoming issues (including, for example, a motion to remand or case scheduling order). Thus, any party who has not submitted its consent/decline designation shall do so by 11/14/2022. Failure to submit a consent/decline designation will result in future delays in this case.
