Newman on 5/9/2023: On April 18, defendant removed this action from California Superior Court, and the case was directly assigned to the magistrate judge under Appendix A sub. (m) of the court's Local Rules. (ECF Nos. #1 , #6 .) Under the initial scheduling order, the parties were to have filed their consent/decline forms regarding magistrate judge jurisdiction within 14 days of removal. This deadline has passed, and a review of the docket indicates no consent forms have been filed. The parties are not required to consent, and the magistrate judge will not be notified of a party's election unless all parties consent. However, this case cannot proceed further until all consent forms are filed. This is especially important because it appears defendant may intend to move to compel arbitration. If such a motion were filed prior to the submission of the consent forms, the hearing would be vacated and the motion would be tabled until the consent issue is resolved. If no arbitration motion is forthcoming, the court will proceed with scheduling of the case.
