Drozd on 1/2/2024: In light of plaintiff's #10 opposition to defendant's #6 motion to dismiss, in which plaintiff requests leave to file a first amended complaint to include additional allegations to address the deficiencies identified in defendant's motion, coupled with the Ninth Circuit's policy of "extreme liberality generally in favoring amendments to pleadings" and that leave to amend should be granted "freely" when justice so requires, see Rosenberg Bros. & Co. v. Arnold, 283 F.2d 406, 406 (9th Cir. 1960); Fed. R. Civ. P. 15(a), defendant's #6 motion to dismiss is hereby GRANTED with leave to amend. Accordingly, the hearing on the #6 motion currently set for 1/16/2024 is hereby VACATED. Plaintiff shall file a first amended complaint no later than twenty-one (21) days from the date of entry of this order. (Buzo, P) |
