| Filing 7 MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for Senior District Judge John A. Mendez on 12/02/2025: On December 1, 2025, Plaintiff filed a complaint and an "Ex-parte stay requested of the WIC 366.26 hearing set on 12/03/2025." ECF Nos. #1 , #2 . In her ex-parte filing, Plaintiff asks this Court to stay a state court hearing, scheduled for December 3, 2025, in the Sacramento Superior Court. ECF No. #2 . Plaintiff's filing appears to be a request for a temporary restraining order, however it is procedurally defective. See Fed. R. Civ. P. 65 and E.D. Cal. L.R. 231 (requiring, among other things, a motion, brief, affidavit, proposed temporary restraining order with a provision for a bond, and certification by the attorney of efforts to give notice to the opposing party). Even if the Court were to consider the Plaintiff's request, the longstanding rule - that a "Federal court cannot [] interfere in a case where the proceedings were already pending in a state court" - applies here. Juidice v. Vail, 430 U.S. 327, 335 (1977) (quoting Ex parte Young, 209 U.S. 123, 162 (1908)) (other citations omitted). This Court cannot intervene to stay a state court proceeding as requested. Accordingly, Plaintiff's ex-parte stay request (ECF No. #2 ) is DENIED. (Deputy Clerk MDY) |
