Filing 355 RESPONSE to re #349 Order on Administrative Motion to File Under Seal,, 353 Order on Motion for Extension of Time to File,,,, (Joint Statement) by Kaiser Foundation Health Plan, Inc.. (Eakins, Jan) (Filed on 12/20/2016) |
Filing 354 AMENDED NOTICE OF APPEAL by Jeremy L Friedman as to #350 Order . Appeal Record due by 1/6/2017. (Friedman, Jeremy) (Filed on 12/7/2016) |
Filing 353 Order granting #351 Motion for Extension of Time to File entered by Magistrate Judge Laurel Beeler. There are two issues: (1) must Mr. Friedman give copies of two emails to Kaiser (see ECF No. 349, paragraph 2), and (2) whether the court has jurisdiction to reconsider its prior sealing orders because it entered its final order (see id., paragraph 3). The two emails are in the record at ECF Nos. 344-3 and 344-4. Mr. Friedman asked for them to be sealed. The court cannot discern their relevance to Mr. Friedman's dispute with Kaiser. If Mr. Friedman does not plan to use them in his dispute against Kaiser, he need not disclose them to Kaiser. If he does plan to use them against Kaiser, then he must disclose them by December 30, 2016. The court grants the extension of time to file the joint brief. It must be filed by January 6, 2017. This is one week beyond the December 30 extension that Mr. Friedman requests. The court will not grant any further extension. (This is a text-only entry generated by the court. Filing 349 Order granting #344 Administrative Motion to File Under Seal entered by Magistrate Judge Laurel Beeler. The attached order grants the motion to seal, directs the filing of redacted copies, and defers the decision on serving the emails on Kaiser and the procedural appropriateness of Mr. Friedman's contemplated motion to reconsider the court's prior sealing orders. Mr. Friedman and Kaiser must file a joint case-management statement by November 22 that addresses the procedural appropriateness of a motion to reconsider the sealing orders. In the statement, the parties also must discuss whether Kaiser really wants copies of the emails and provide legal authority to support their positions if they cannot resolve the dispute. |

Filing 328 ORDER. It appears that the billing summary for all attorneys as of July 2013 (discussed at the hearing) is already part of the record at ECF No. 182-11. Filing 327 Minute Entry for proceedings held before Magistrate Judge Laurel Beeler: Further Motion for Attorney Fees Hearing held on 8/18/2016. For now, the court orders the parts of the hearing that refer to specific programmatic relief and dollar amounts of settlement to be filed under seal, subject to the court's revisiting sealing issues generally when Mr. Friedman files his motion to revisit the sealing orders. The court is also somewhat concerned about Mr. Friedman's reference to the settlement process, though that concern really is about whether the parties have that concern. For now, the court orders the hearing recording sealed. The parties will request a transcript, and everyone will review it and submit redacted and unredacted copies under the ordinary processes for identifying matters to be filed under seal. The court can then file public-record transcripts and a full transcript. The court also suggests this to Mr. Friedman about his contemplated motion to unseal: perhaps he could attach as exhibits the ECF versions of the precise documents that he wants unsealed. There have been a lot of sealing orders, and it may be that documents have been filed many times, and Mr. Friedman might be able to achieve what he wants to with a subset of the universe. Also, if he does this, it might make it easier for Kaiser to agree to some of his proposals, and it makes for an easier record to review. That said, this is just a suggestion, and the court defers to Mr. Friedman's assessment about how he wants to raise the issues. (Digital FTR Recording: 10:55-1:34 - The recording is placed under seal. Counsel who participated in the hearing may obtain a copy of the transcript without a court order.) Plaintiff Attorney: Jeremy Friedman and Ron Lunski. Defendant Attorney: Jan E. Eakins (CourtCall). This is a text only Minute Entry. Filing 321 ORDER RE ATTORNEY FRIEDMAN'S ADMINISTRATIVE MOTIONS FOR LEAVE TO FILE PLEADINGS UNDER SEAL (ECF NOS. 316 &317) by Judge Laurel Beeler: Granting #316 Administrative Motion to File Under Seal; Granting #317 Administrative Motion to File Under Seal. (lsS, COURT STAFF) (Filed on 8/8/2016) |
Filing 320 ORDER RE ECF NO. 318. The court authorizes the plaintiffs to file a sur reply of five pages. The court is not unsympathetic to the plaintiffs' arguments. But the court's approach has been to make sure that Mr. Friedman has an opportunity to make his arguments. It thus will not strike the reply brief and declarations. In the long run, this will ensure a clean record. The court has not read the briefs yet and thus defers to the plaintiffs' assessment that a sur reply is needed now to address new facts and arguments in the reply briefs. That said, this is not a complicated case, and the court is very familiar with the factual and legal issues and is prepared to sort them out at the August 18 hearing. Moreover, the court will address the plaintiffs' evidentiary objections in any event. Finally, this case needs to move to a hearing, and the court allotted a significant chunk of time next week to review the filings. The court also arranged the calendar on August 18 to give enough time to this case. Thus, if the plaintiffs want to file a sur reply, they must do so by August 8, which is one week after the reply was filed (and the court acknowledges the late filing August 2). If Mr. Friedman wants to respond, he may file a three-page sur sur reply by August 10. (Beeler, Laurel) (Filed on 8/5/2016) |

Filing 311 STIPULATION WITH PROPOSED ORDER re Protective Order for Sealed Records filed by Jeremy L Friedman. (Attachments: #1 Proposed Order)(Friedman, Jeremy) (Filed on 7/18/2016) |
Filing 310 Discovery Order. The court reviewed the parties' disagreements about the protective order. For page 2:3, the court cannot see what the issue is. Both seem fine. For page 2:7-12, the court is not inclined to make Mr. Friedman list what he gives his expert in the protective order. Thus, the court rejects Kaiser's limitation and adopts Mr. Friedman's language. For page 2:15-18, the court agrees with Kaiser that the expert cannot retain the records after the dispute is resolved. (Beeler, Laurel) (Filed on 7/13/2016) |
Filing 309 ORDER granting in part and denying in part #307 Discovery Letter Brief; granting in part and denying in part #308 Discovery Letter Brief. The court appreciates Kaiser's position that the issue of entitlement to fees at all is step one, but the court is not going to bifurcate the issues. The court had specific reasons for identifying the issues as it did; one reason is not just Mr. Friedman's entitlement to fees but also is his "ask" from his clients. The court thinks it useful for Mr. Friedman to make his "ask" in the context of his actual fees. As to what his expert should review, that is Mr. Friedman's call. Finally, it is not unusual to have experts or paralegals or other folks with access to private information to sign an acknowledgment that they read and will comply with the requirements of a protective order. It is a small thing, and the court cannot see why it cannot be filed (thus giving Kaiser the reassurance it wants.(Beeler, Laurel) (Filed on 7/13/2016) |

Set/Reset Deadlines as to: Replies due by 7/25/2016. Motion Hearing set for 8/18/2016 at 9:30 AM in Courtroom C, 15th Floor, San Francisco before Magistrate Judge Laurel Beeler. (lsS, COURT STAFF) (Filed on 6/27/2016) |
Filing 304 STIPULATION WITH PROPOSED ORDER re 303 Order on Motion for Extension of Time to File Response/Reply,,,,,,,, filed by Jeremy L Friedman. (Friedman, Jeremy) (Filed on 6/24/2016) |
Filing 303 ORDER granting #295 Motion for Extension of Time to File Response/Reply re #295 MOTION for Extension of Time to File Response/Reply as to #293 Order on Stipulation (Until Joint Submission) Joint proposed scheduling order due by 6/24/2016. The court obviously needs Mr. Friedman's reply before it can consider the pending motion. And the plaintiffs are right: this case needs to move along. As the court said in its 9/1/2015 order, there are different issues: 1) is there a landscape (such as fee agreements or a legal theory) that supports Mr. Friedman's claim to fees beyond those awarded in the settlement agreement, and 2) if so, what is his specific demand from the clients (fixed as a precise dollar amount) and are those fees "reasonable fees" under the ordinary lodestar analysis. The court thinks that at last issue one can be addressed in the reply now, and issue 2 needs to be addressed expediently, given that this dispute has been pending for over a year. The court directs the parties to confer within two business days on their proposed schedule and file their proposed scheduling order in the same chart format that they have been using (with a blank column for the court's decision). That chart must contain their proposed hearing date. After the court receives Mr. Friedman's submission, the plaintiffs can evaluate whether they need to say more (and the court will order more if it thinks it necessary. The court understands the fees landscape very well and thinks it can probably navigate the dispute once it receives Mr. Friedman's reply. To avoid losing track of the case, the court sets a case-management conference for 6/30/2016 at 11 a.m. but will vacate it in favor of a hearing date once it receives the parties' proposed scheduling order this Friday. The court reminds the parties to file the proposed order and to submit a Word version to the orders box at lbpo@cand.uscourts.gov.(Beeler, Laurel) (Filed on 6/22/2016) |

Filing 287 The plaintiffs filed an administrative motion to to file under seal their opposition to attorney Jeremy Friedman's motion for attorneys fees. (ECF No. 284.) The defendants filed a response to include additional required redactions of monetary settlement figures. (ECF No. 286.) In their response, the defendants refer to "Plaintiff's [Redacted] Opposition (ECF No. 284-1)" and, citing thereto, request additional redactions on page 9, lines 6, 10, and 16. (Id. at 2.) The court may be missing something but does not see dollar amounts at some of those citations. For example, the court does not see a dollar amount on page 9, lines 6 or 16. The court thus asks the defendants to double check the pin cites and file a short supplemental filing clarifying the pin cites within four days. (This is a text entry order generated by the court. Set/Reset Deadlines as to #183 MOTION TO ENFORCE SETTLEMENT AGREEMENT. Motion Hearing set for 8/6/2015 at 9:30 AM in Courtroom C, 15th Floor, San Francisco before Magistrate Judge Laurel Beeler. (lsS, COURT STAFF) (Filed on 6/18/2015) |
Filing 204 CASE MANAGEMENT SCHEDULING ORDER: Telephonic Case Management Conference set for 6/18/2015 11:00 AM. Mr. Friedman has advised the court that he was planning to travel to join his family for the family wedding on June 23, 2015. (ECF No. 202.) He also asked for an extension of time to file his reply, which is due today. (Id.) This morning he advised courtroom deputy Lashanda Scott of an additional personal conflict. He did say that he put his scheduling on hold pending a decision on his motion for an extension of time. (Id.) The court also notes that while other counsel represented that people made arrangements to attend the hearing on June 25, 2015, no one mentioned any prepaid airline tickets or the like. Under the circumstances (including the fact that the briefing is now too chaotic for the court to hear the case on the accelerated schedule that it set previously), Mr. Friedman may file his reply on or before June 23, 2015. The court directs the parties to confer today or tomorrow morning and pick a new hearing date. The hearing must be on a Thursday at 9:30 a.m. (except that the court will consider setting it later on Thursday morning to accommodate any travel schedules). July 8 is not available. The parties must then file a one-page statement with the hearing date no later than 10:30 a.m. on Thursday, June 18, 2015. If the parties have not picked a date, they must appear by telephone at 11:00 a.m. The court will call the case at the end of the (short) CMC calendar. If the parties file a statement picking a date, the court will vacate the call and reset the hearing. (This is a text entry order generated by the court. There is no document associated with this entry.) Signed by Judge Beeler on 6/17/2015. (Laurel Beeler) (Filed on 6/17/2015) Modified on 6/18/2015 (lsS, COURT STAFF). |

Filing 192 Order by Magistrate Judge Laurel Beeler granting in part and denying in part #191 Motion for Leave to File. The court grants in part the motion for reconsideration. The court defers the final decision on the timing until after the filing of the opposition and the cross-motion, which will be filed today. The court is also concerned that the plaintiffs and counsel made plans to be here on June 25, 2015. One possibility is to set the hearing at 8:30 a.m., which will give Mr. Friedman time to get to the aiport for the 11 a.m. flight. A second possibility is to set the hearing the day before. The court directs the parties to discuss the timing options tomorrow (June 4) and file one-page update with their positions on timing that same day. Filing 191 MOTION for Leave to File Motion to Reconsider Denial of Administrative Motion re Hearing on Motions filed by Jeremy L Friedman. (Friedman, Jeremy) (Filed on 6/2/2015) |
Filing 190 ORDER DENYING #187 MR. FRIEDMAN'S ADMINISTRATIVE MOTION TO CONTINUE HEARING AND SET CONSOLIDATED HEARING ON RELATED MOTIONS. The court denies Mr. Friedman's administrative motion to continue given the substantial scheduling efforts of counsel and the parties to attend the June 25 hearing. The motion and cross-motion will be fully briefed by June 25. A flight to Minneapolis is roughly 3. 5 hours, and there are afternoon flights that would put Mr. Friedman there by evening. Nothing in his personal schedule suggests that this is not an appropriate approach. Also, Mr. Friedman's consolidated opposition/cross-motion is due June 3, 2015. The court will shorten the briefing schedule slightly. The plaintiffs' consolidated reply/opposition to the cross-motion is due June 10, 2015 (although the court will entertain a request by the plaintiffs to extend that time after looking at the motion). Mr. Friedman's optional reply in support of his cross-motion will be due June 17, 2015. Signed by Magistrate Judge Laurel Beeler on 6/2/2015.(lblc2, COURT STAFF) (Filed on 6/2/2015) |
