Plaintiffs Federal Trade Commission, State of Illinois and State of Ohio alleged that defendants used deceptive marketing tactics to enroll consumers in their credit marketing program. Defendants allegedly represented that consumers could obtain their credit for free or for a $1 processing fee, but failed to disclose that (1) consumers would be automatically enrolled in a negative option continuity plan with additional charges; (2) consumers must cancel the plan before the end of the trial period to avoid additional charges; (3) defendants would use consumers' credit card information to charge a monthly fee for the plan; (4) the costs of the monthly plan.
