August 29, 2019 Opinion or Order Filing 29 ORDER. Plaintiff's request to voluntarily dismiss the case under FRCP 41(a)(2), Dkt. No. 24, is granted. The case is at a very early stage, no orders on any pending motions are imminent, and defendants will not suffer any plain legal prejudice from dismissal. Defendants' suggestion that they will be prejudiced by a possibility of future litigation or having to defend against plaintiff's claims in another forum are not the type of prejudice that weighs against voluntary dismissal. See Smith v. Lenches, 263 F.3d 972, 976 (9th Cir. 2001). That defendants have incurred legal expenses to this point is also not legal prejudice. See Westlands Water Dist. v. United States, 100 F.3d 94, 97 (9th Cir. 1996). That is all the more true here, where it appears a substantial amount of defendants' legal work could be used in any future litigation of these claims.
