MINUTE ORDER. This matter concerns the same subject matter as an earlier-filed case pending in the Northern District of California, Behring Regional Center LLC v. Mayorkas, 22-cv-2486-VC (N.D. Cal.): USCIS's deauthorization of regional centers. Accordingly, to avoid duplicative litigation and in the interest of judicial economy, and without objection from the parties, see ECF Nos. #19 & #20 , the court orders this matter transferred forthwith to the Northern District of California to be consolidated with the Behring Regional Center matter. See Handy v. Shaw, Bransford, Veilleux & Roth, 325 F.3d 346, 349-50 (D.C. Cir. 2003). Signed by Judge Amit P. Mehta on 07/05/2022. (lcapm3) |

MINUTE ORDER. The court understands that Judge Chhabria in the Behring matter has issued a nationwide preliminary injunction that bars USCIS from "treating as deauthorized the previously designated regional centers based on its almost certainly erroneous interpretation of the Integrity Act." Order Granting Plaintiff's Mot. for Prelim. Inj., Behring Regional Center LLC v. Mayorkas, 22-cv-02487-VC, ECF No. 63, at 13 (N.D. Cal. June 24, 2022). The parties in this matter shall advise the court by June 29, 2022, whether the Behring decision has mooted the request for preliminary relief sought in this case. If mooted, the parties shall further advise how to proceed in this matter, including possibly transferring this action to the Northern District of California. See Handy v. Shaw, Bransford, Veilleux & Roth, 325 F.3d 346, 349-50 (D.C. Cir. 2003) ("In the case of parallel litigation in two federal district courts, the 'general principle is to avoid duplicative litigation.' . . . So long as the parallel cases involve the same subject matter, the district court should-for judicial economy-resolve both suits in a single forum. . . . Where the issues arise out of the same 'transaction,' as they do here, the district court next decides which district court should adjudicate the case." (citations omitted)). Signed by Judge Amit P. Mehta on 06/26/2022. (lcapm3) |
