Order by Magistrate Judge Laurel Beeler denying without prejudice as premature 40 Motion for Summary Judgment and granting in part Plaintiff's 42 motion to extend the time to hear the Motion for Summary Judgment. For the reasons set fo rth in the attached order, the courts view is that the parties' personal and business dynamics might be better addressed by at least attempting mediation before litigation. There is room in the current schedule to accommodate an early summary-judgment motion after mediation and before any big spend on discovery.
