February 15, 2022 Opinion or Order Filing 18 ORDER: Plaintiff has filed a response stating that he does not object to Defendants' motion to transfer venue or, in the alternative, to stay this case. Therefore, the motion to transfer this case to the Northern District of California #9 is granted. February 10, 2022 Filing 16 Notice of Supplemental Authority by Deb Haaland, U.S. Department of the Interior, U.S. Fish & Wildlife Service, Martha Williams (Attachments: #1 Exhibit 1)(Cevallos, Astrid)
February 9, 2022 Filing 15 MINUTE entry before the Honorable Martha M. Pacold: On 12/27/2021, defendant filed a motion to transfer this case or, in the alternative, to stay. #9 . The court set a briefing schedule on that motion, requiring plaintiff to respond by 2/11/2022. #12 . Plaintiff filed a 26-page brief in response and did not seek leave of the court to file an oversized brief. Under Local Rule 7.1 "Neither a brief in support of or in opposition to any motion nor objections to a report and recommendation or order of a magistrate judge or special master shall exceed 15 pages without prior approval of the court.... Any brief or objection that does not comply with this rule shall be filed subject to being stricken by the court." There is no apparent need for an oversized response brief; the opening brief was 14 pages. There is also no indication that plaintiff conferred with defendant regarding whether there was a need for the parties to file oversized briefs. Thus, the court strikes the response brief #14 . Plaintiff is directed to refile the response brief by 2/16/2022 in compliance with Local Rule 7.1's page limits. The time for defendants to file a reply is extended to 3/4/2022. (rao, )
