ORDER OF PARTIAL DISMISSAL AND OF SERVICE; DIRECTING DEFENDANTS TO FILE DISPOSITIVE MOTION OR NOTICE REGARDING SUCH MOTION; INSTRUCTIONS TO CLERK. The Clerk of the Court shall mail a Notice of Lawsuit and Request for Waiver of Service of Summon s, two copies of the Waiver of Service of Summons, a copy of the second amended complaint, (Docket No. 10), all attachments thereto, and a copy of this order upon Defendants Dr. T, Friedrichs and Nurse M. Fernandez at the Correctional Training Facili ty - Soledad (P.O. Box 689, Soledad, CA 93960). The Clerk shall also mail a copy of this Order to Plaintiff. The Clerk shall terminate all other defendants from this action as Plaintiff has failed to state cognizable claims against them in the second amended complaint. Signed by Judge Edward J. ORDER OF DISMISSAL WITH LEAVE TO AMEND. For the foregoing reasons, the amended complaint is DISMISSED with leave to amend. Within twenty-eight (28) days of the date this order is filed, Plaintiff shall file an amended complaint. The amended complaint must include the caption and civil case number used in this order and the words "AMENDED COMPLAINT" on the first page and write in the case number for this action, Case No. C 12-04554 EJD (PR). If using the court form complaint, plaintiff must answer all the questions on the form in order for the action to proceed. Failure to respond in accordance with this order by filing an amended complaint will result in the dismissal of this action without prejudice and without further notice to Plaintiff.
