| [10960068] Order filed by Clerk of the Court. On Novemer 18, 2022, this court issued an order abating proceedings in this appeal due to a pending district court post-judgment motion. We also noted that the district court had not decided whether to grant a certificate of appealability. Through our own research, we discovered that the district court entered an order on 12/5/2022, denying the pending post-judgment motion and issuing an amended judgment declining to issue a certificate of appealability. The abatement of proceedings in this appeal are lifted. Appellant must either pay the appellate filing fee or file a motion seeking in forma pauperis in this district court, and file an entry of appearance on or before 12/19/2022 as stated in this court's case opening letter.
