USDC order denying COA as to Appellant Charlene Terry-Ann Walker Rosa was filed on 04/02/2020. Docket Entry 13. PAPERLESS ORDER denying 11 Motion for Certificate of Appealability. A Certificate of Appealability ("COA") is required when an appeal is taken from a final order in a habeas corpus proceeding under 28 U.S.C. 2254 or 2255. See 28 U.S.C. 2253(c)(1). A COA may issue only when "the applicant has made a substantial showing of the denial of a constitutional right." 28 U.S.C. 2253(c)(2). But when, as here, the Court dismisses a (successive) habeas petition on procedural grounds, a COA issues only if "jurists of reason would find it debatable whether the petition states a valid claim of the denial of a constitutional right and that jurists of reason would find it debatable whether the district court was correct in its ruling." Slack v. McDaniel, 529 U.S. 473, 484 (2000). Based on the facts of this case, no reasonable jurist could come to either conclusion. Moreover, the Plaintiff-Petitioner maintains that her cause of action arises under 42 U.S.C. 1983--in which case she would not need to obtain a COA before appealing the Court's ruling.
