Date Filed Document Text
June 17, 2022 Opinion or Order ORDER: A jurisdictional question was issued in this appeal asking the parties to address how the September 22, 2017 sanctions order affected our jurisdiction. Although the district court awarded Houston Pipe Line Company, L.P. and HPL GP, LLC attorneys fees and costs in that 2017 sanctions order, the district court has not yet calculated the amount of attorneys fees and costs. We conclude that we lack jurisdiction over this appeal because that 2017 sanctions order is intertwined with the district courts subsequent decision to grant summary judgment for Houston Pipe Line Company, L.P. and HPL GP, LLC. See Jaffe v. Sundowner Properties, Inc., 808 F.2d 1425, 1426 (11th Cir. 1987). Accordingly, we lack jurisdiction until the district court calculates the amount of attorneys fees and costs. This appeal is DISMISSED for lack of jurisdiction. All pending motions are DENIED as moot AJ, JP and ALB [Entered: 06/17/2022 11:46 AM]
January 31, 2022 Opinion or Order ORDER: The motion for extension of time in which to file Appellants brief and appendix is GRANTED. If the appeal is allowed to proceed, Appellants brief will be due fourteen days from the date that probable jurisdiction is noted, with the appendix due within seven days of the filing date of Appellants brief.
