ORDER: Mark Henderson, as Administrator of the Estate of Christopher Henderson, appeals from the district courts judgment entered for defendant Ford Motor Company (Ford) following a jury trial, and from the orders denying his motions for judgment as a matter of law and for a new trial. Ford has also filed a conditional cross-appeal from the district courts pretrial order denying a motion to exclude an experts opinion, as well as the orders denying its motions for judgment as a matter of law. Hendersons motion to amend the jurisdictional allegations in the complaint is GRANTED. See 28 U.S.C. 1653. The complaint is amended to allege as follows: The Plaintiff, Mark Henderson, is an individual over the age of nineteen (19) and is a citizen of the State of Alabama. The decedent, Christopher Henderson, at the time of his death was a citizen of the State of Alabama. Plaintiff Mark Henderson is the duly appointed Administrator of the Estate of Christopher Henderson, deceased. Letters of Administration were granted to him on November 13, 2017 by the Probate Court of Lawrence County, Alabama. We deem the pleadings, as amended, sufficient to establish the district courts diversity-based subject matter jurisdiction. See 28 U.S.C. 1332(a)(1), (c)(1)-(2). The parties are directed to file notice of this order in the district court, along with copies of the amended complaint and this order.
