CLERK ORDER On September 10, 2015, the Clerk granted Appellant's request for leave to proceed in forma pauperis and advised that the appeal will be submitted for determination under 28 U.S.C. Section 1915(e)(2) as to whether the appeal will be dismissed as legally frivolous or whether summary affirmance under Third Circuit L.A.R. 27.4 and I.O.P. 10.6 is appropriate. Upon further review, listing the appeal for determination under Section 1919(e)(2) as to whether the appeal is legally frivolous or whether summary action is appropriate was done in error. Accordingly, to the extent that the September 10, 2015 order lists the case for possible dismissal and summary action, the order is hereby vacated. It is noted that Appellant maintains in forma pauperis status and the Court may reconsider that status or request additional information at any time during the course of these proceedings. As Appellant was previously advised, the appeal will be submitted to panel of the Court on the application for a certificate of appealability, filed. (MLR) [Entered: 01/21/2016 10:55 AM] |
