MOTION filed by Appellant Michael Strausbaugh to Clarify Order dated March 11, 2019 re: Payment of Appeal Fees. Certificate of Service dated 03/18/2019. Service made by US mail. (ARR) [Entered: 04/03/2019 11:32 AM] |
OBJECTION filed by Appellant Michael Strausbaugh to the Clerk's Order of March 11, 2019 Staying the Appeal, filed. Certificate of Service dated 03/18/2019. Service made by US mail. (ARR) [Entered: 04/03/2019 11:37 AM] |
ORDER (Clerk) Accordingly, it is ORDERED that the above-captioned appeal is stayed. Cf. 11 U.S.C. Section: 362(a). Any objection to this stay must be filed within ten days. The appellant and Ditech Financial, L.L.C., f/k/a Green Tree Servicing, L.L.C, are directed to file status reports within 90 days of this order and every 90 days thereafter until the automatic stay is lifted, the bankruptcy case is closed or dismissed, or a bankruptcy discharge is granted or denied. The appellant's failure to comply with this status-report requirement may result in the administrative termination of the appeal. This stay does not excuse the appellant from paying the filing and docketing fees for this appeal. The appellant has not yet done so. Within fourteen days of this order, he must either pay the full $505 fee or file a motion asking this Court for permission to appeal in forma pauperis. Although the district court previously granted the appellant in-forma-pauperis status, that does not automatically entitle him to proceed in forma pauperis on appeal. See 28 U.S.C. Section: 1915(a)(2); Fed. R. App. P. 24(a)(3)(B). If he wants to proceed in forma pauperis on appeal, the appellant must file a motion in this Court asking for permission to proceed in forma pauperis. See 3d Cir. L.A.R. 24.1(a). , filed.
