According to the petitioner's letter, he served a copy of that document on the district attorney but will not be able to send a copy to this Court until early June. Based on this letter, the petitioner can be granted an extension of time. The petitioner must submit a copy of his proposed new habeas petition to this Court within twenty-one (21) days of this order. May 17, 2019 Opinion or Order ORDER (Clerk) Petitioner was previously advised by Clerk order, entered April 9, 2019, that if he wants the Court to consider his motion under 28 U.S.C. Section 2244 for an Order Authorizing the District Court to Consider a Second or Successive Application for Relief Under 28 U.S.C. Section 2254, he must file the new proposed habeas petition. On May 6, 2019, the Clerk received a certificate of service from Petitioner, but no document was included with the certificate. Therefore, it is hereby ORDERED that Petitioner submit the following document within 21 days of the date of this order: the new proposed habeas petition. See 3d Cir. LAR 22.5(a). Because the proper documents were not included with the Section 2244 application, the application is deemed lodged with the Court. Petitioner must serve a copy of the new proposed habeas petition on the District Attorney of Philadelphia. Petitioner must also file a certificate of service with the Clerk of the Court of Appeals demonstrating that the document has been served. Respondent may file a response within seven (7) days of the filing of Petitioner's completed application. The deadlines set forth in this order supersede any other deadlines set in this case. No action will be taken regarding Petitioner's application until the Clerk receives copies of the above-listed document.
