CLERK ORDER In light of the filing of the cross-petitions for review, the applications for enforcement at Nos. 19-1782, 19-1794, 19-1795, and 19-1796 are now consolidated for all purposes. In addition, the cross-petitions for review at Nos. 19-1993, 19-1994, 19-1995, and 19-1996 are also consolidated for all purposes. At the appropriate time, the Clerk will issue one consolidated three-step briefing schedule covering all eight (8) cases. In accordance with Fed. R. App. P. 15 and 3d Cir. L.A.R. 15.1, the companies will file the first and third step briefs and the NLRB will file the second-step brief. Any objections to this order must be filed within seven (7) days of the date of this order. The parties are advised that all motions and briefs must be electronically filed in all cases on the Court's electronic case filing (ECF) system. The parties are also advised that case opening forms for later filed cases must only be filed in the new cases and not re-filed in earlier cases in which the forms were previously filed. The parties are further advised that failure to file documents in the appropriate case may result in the issuance of a noncompliance order. If any party is unsure how to file a particular document, he or she should call the case manager prior to filing the document, filed. [19-1782, 19-1794, 19-1795, 19-1796, 19-1993, 19-1994, 19-1995, 19-1996] (PDB) [Entered: 05/03/2019 11:51 AM] |
TEXT ONLY ORDER (Clerk). [19-1782, 19-1794, 19-1795, 19-1796]. On April 29, 2019, Alaris Health electronically filed four separate cross-petitions for enforcement in the existing actions. See Nos. 19-1782, 19-1794, 19-1795 and 19-1796. Each cross-petition should have been separately filed as an original proceeding and not filed in the existing actions. Therefore, each cross-petition will be assigned a new appeal number, see Fed. R. App. P. 15(b)(1). A separate fee is required for each new cross-petition that has been filed. See Fed. R. App. P. 15(e). Counsel is directed to file any documents related to the cross-petitions in the new actions, not in the actions that are already open involving the NLRB's applications for enforcement.
