October 18, 2019 Opinion or Order ORDER (Clerk) Portions of this case are sealed in the District Court, some of which may be included in submissions to this Court. When the district court seals part or all of the documents in a case collaterally attacking a conviction and the documents are transmitted to this Court as part of the record, the documents remain subject to the district court's impoundment order and are placed under seal by the Clerk of this Court until further order of this Court. The party seeking to have the document(s) sealed must file a motion within 21 days of receiving notice of the docketing of the appeal in this Court. The motion should specify the scope of the relief requested by identifying the specific documents in the record that should remain sealed by title, filed date, and docket entry number; the basis for sealing; and the desired duration of the sealing order. The parties should refrain from requesting sealing of an entire document and should consider filing a separate sealed supplemental document or redacted versions of the documents. All parties are directed to use the CM/ECF events preceded by the word SEALED whenever filing any documents which may contain sealed material. All hard copies of documents submitted to this Court should be properly labeled that they are SEALED and provided in a clearly marked envelope. It is counsel's responsibility to ensure that any documents are properly filed under SEAL. [See Order for Full Text.]. (CJG) [Entered: 10/18/2019 08:50 AM]
October 18, 2019 Opinion or Order ORDER (Clerk) The District Court granted a certificate of appealability in this case in an order entered March 21, 2019. Third Circuit I.O.P. 10.3.3 provides for the appointment of counsel upon the granting of a certificate of appealability provided the appellant is indigent. It is noted that Appellant chose to proceed pro se in the District Court, but the District Court appointed Terence M. Grugan, Esq. as stand-by counsel under the Criminal Justice Act. Appellant is advised that this Court does not appoint counsel in a stand-by capacity. Accordingly, if Appellant would like to have counsel appointed to represent him in this appeal, he must so notify the Clerk in writing within 14 days of the date of this order. Should Appellant elect to have counsel appointed, Appellant may not file any motions or other documents pro se. See 3d Cir. L.A.R. 27.8. (CJG) [Entered: 10/18/2019 08:54 AM]
October 18, 2019 PARTIAL RECORD available on District Court CM/ECF. (CJG) [Entered: 10/18/2019 08:57 AM]
