ORDER (Clerk) Action on the motion to withdraw and motion for leave to proceed in forma pauperis are hereby deferred. Appellant's request to temporarily stay the proceedings for fourteen (14) days, to include the request to stay ruling on the motion to proceed in forma pauperis is granted. Appellant is advised that, as this an appeal from a 28 U.S.C. Section 2241 action, fees are not assessed or collected from Appellant's inmate account if in forma pauperis status is granted. Given this, if Appellant wishes to continue with the appeal and have the Court consider the in forma pauperis motion, he must submit a 6-month prison account statement. The statement must include the current account balance as the statement submitted with the motion only shows deposits and withdrawals. The prison account statement must be filed within fourteen (14) days of the date of this order. Failure to file the statement within that time may result in the dismissal of this action without further notice. (MB) [Entered: 12/11/2019 11:45 AM] |
