Filing 13 ORDER (Clerk) Action on the motion to compel and the trial transcript request is hereby deferred. It is noted that Appellant was originally granted leave to proceed in forma pauperis by the District Court on January 22, 2016. At the time Appellant filed the notice of appeal in this case, however, he also filed a new motion to proceed in forma pauperis on appeal. On March 19, 2020, Appellee Maracinni filed a response in opposition which calls into question Appellant's in forma pauperis status. No action was taken by the District Court on either filing. Accordingly, before the Court can consider the motion to compel the District Court to provide Appellant copies of evidence, records, and trial transcripts at the court's expense, Appellant must file a new motion to proceed in forma pauperis and an updated affidavit of poverty. A form affidavit is enclosed for Appellant's convenience. The new motion and affidavit of poverty must be filed within 14 days of the date of this order. Any response to the motion to compel, new motion to proceed in forma pauperis, and affidavit of poverty must be filed within 10 days of the date of the filing of the new motion and affidavit. If Appellees file a response to the motions, Appellant may file a reply within 7 days of the date of the filing of the response. Once the affidavit, any responses, and reply are filed, the motion to compel, trial transcript request, motion to proceed in forma pauperis, affidavit, responses, and reply will be forwarded to a motions panel for disposition. Briefing is stayed pending disposition of the motions. A new deadline for Appellant's brief and appendix will be set at the appropriate time.
