Filing 3 ORDER (Clerk) It is noted that portions of this case are sealed in the District Court, some of which may be included in submissions to this Court. When the district court seals part or all of the documents in a criminal case and the documents are transmitted to this Court as part of the record, the documents remain subject to the district court's impoundment order and are placed under seal by the Clerk of this Court until further order of this Court. 3d Cir. L.A.R. Misc. 106.1(c)(1). The party seeking to have the document(s) sealed must file a motion within 21 days of receiving notice of the docketing of the appeal in this Court. In accordance with Rule 106.1(c)(1), the motion should specify the scope of the relief requested by identifying the specific documents in the record that should remain sealed by title, filed date, and docket entry number; the basis for sealing; and the desired duration of the sealing order. The parties should refrain from requesting sealing of an entire document and should consider filing a separate sealed supplemental document or redacted versions of the documents. See 3d Cir. L.A.R. Misc. 106.1(a). In the event it becomes necessary to submit the documents in question to the Court prior to the disposition of the motion to seal, those documents must be submitted separately and the Court must be apprised that the material is sealed. All parties are directed to use the CM/ECF events preceded by the word SEALED whenever filing any documents which may contain sealed material. All hard copies of documents submitted to this Court should be properly labeled that they are SEALED and provided in a clearly marked envelope. It is counsel's responsibility to ensure that any documents are properly filed under SEAL.. (JK) [Entered: 06/24/2020 04:17 PM] |
