| Filing 3 NONCOMPLIANCE Order Action on the above-captioned petition for writ of mandamus and motion for leave to proceed in forma pauperis is hereby deferred. The motion for leave to proceed in forma pauperis submitted with the mandamus petition was not sufficiently complete for the Court to rule on at this time. It did not include (1) an affidavit of poverty in the form prescribed by the Federal Rules of Appellate Procedure and (2) a statement of Petitioners institutional account for the six months prior to this date. The petitioner must provide those documents to this Court if he wants to proceed in forma pauperis. See 3d Cir. L.A.R. 24.1(c). Within fourteen (14) days of the date of this order, Petitioner must either remit payment of the $500 docketing fee or complete his motion for leave to proceed in forma pauperis by filing the required affidavit of poverty and account statement. A form affidavit is enclosed for Petitioners convenience. The mandamus petition will not be submitted to the Court until the docketing fee has been paid or leave to proceed in forma pauperis has been granted. See Fed. R. App. P. 21(a)(3). If neither the fee nor a compliant motion to proceed in forma pauperis is received by the deadline, the petition will be dismissed without further notice. See 3d Cir. L.A.R. 24.2, 107.1.
