Filing 4 ORDER (Clerk) advising that the case has been listed for possible dismissal due to jurisdictional defect. The appellants seek review of an order granting summary judgment to one defendant. Because the claims against the other defendant were voluntarily dismissed without prejudice, this may not be a final decision under 28 U.S.C. Section: 1291 or otherwise appealable. See, e.g., Doe v. Hesketh, 828 F.3d 159, 16467 (3d Cir. 2016) ("Ordinarily, we do not have jurisdiction under Section: 1291 of an appeal in which any defendant was dismissed below by the district court without prejudice."). All parties must file written responses addressing this issue within fourteen (14) days of this order. (ARR) [Entered: 09/30/2020 10:47 PM] |
Filing 3 ORDER (Clerk) Pursuant to Federal Rule of Civil Procedure 5.2(a)(3) (incorporated by Federal Rule of Appellate Procedure 25(a)(5)) and Third Circuit Local Appellate Rule 113.12(a)(2), the names of minor children must be redacted from all filings. Litigants are responsible for redacting documents. Accordingly, this appeal has been docketed under the initials of the minor appellant, rather than the minor child's full name. It appears the parties appropriately ensured the privacy of the minor child during the district-court proceedings, and it is anticipated that they will continue to do so in this appeal. All filings should be in compliance with the above-mentioned rules. The Clerk will not review each filing for compliance. Although the minor child's parents litigated under their initials during the district-court proceedings, it does not appear they ever requestedor were grantedpermission to do so. If the parents wish to continue using only initials on appeal, they must file in this Court a motion requesting such relief within fourteen (14) days of this order. Answer due 10/14/2020. (ARR) [Entered: 09/30/2020 10:35 PM] |
Filing 2 RECORD available on District Court CM/ECF. (ARR) [Entered: 09/30/2020 10:25 PM] |
