ORDER (AMBRO, SHWARTZ and PORTER, Circuit Judges) Appellant's notice of appeal, filed on March 9, 2021, from the District Court's order entered January 13, 2021, appears to be untimely because he did not file it within 30 days of the date of that ruling. See Fed. R. App. P. 4(a)(1)(A). In his notice of appeal and its accompanying affidavit, however, Appellant stated that he was "physically [and] mentally unable to file this appeal until" the date of his notice of appeal. Accordingly, because Appellant's notice of appeal and accompanying affidavit may be construed as stating a ground to extend the appeal period under Rule 4(a)(5) of the Federal Rules of Appellate Procedure, this matter is remanded for the District Court to make this determination.
