September 28, 2021 Opinion or Order Filing 7 ORDER (Clerk) The above docketed appeals are hereby consolidated for all purposes. The parties are advised that all case opening forms, motions, and briefs, if a briefing schedule issues, must be electronically filed in all cases on the Court's electronic case filing (ECF) system. It is noted that Appellant chose to waive his right to counsel and proceed pro se in the District Court. Appellant is hereby advised that unlike proceedings in District Court, there is no right to proceed pro se on appeal. It is noted that Appellant seeks review of two District Court orders entered September 15, 2021, denying various pre-trial motions. The orders on appeal are not final and are not otherwise appealable at this time. See Flanagan v. United States, 465 U.S. 259, 263 (1984). If Appellant elects to waive counsel and proceed pro se, Appellant must file and serve a written response addressing this Court's authority over the appeals, with a certificate of service attached, within fourteen (14) days of the filing of the waiver form. If Appellant elects to accept representation by Mark A. Sindler, Esq., or if Appellant fails to respond to this Order, then Mark A. Sindler, Esq. must file and serve a written response addressing this Court's authority over the appeals within fourteen (14) days of either the filing of Appellant's written statement accepting representation or the expiration of Appellant's response time, whichever occurs first.
