October 29, 2021 Opinion or Order Filing 4 ORDER (Clerk) It appears that Petitioner is attempting to file a petition for writ of mandamus. Action on the above-captioned petition is hereby deferred. Petitioner submitted a motion to proceed in forma pauperis with the petition, however, the affidavit form has not been fully completed. The section is blank regarding how much cash Petitioner. Accordingly, action on the motion to proceed in forma pauperis is deferred. Within fourteen (14) days of the date of this order Petitioner must file a fully completed signed form. This Courts form affidavit is enclosed for Petitioners convenience. If applicable, as required by the affidavit form and statute, the motion must be accompanied by a certified statement of Petitioners institutional account for the six months prior to this date. It is noted that a petition for writ of mandamus is an original action and a separate motion for leave to proceed in forma pauperis must be filed, regardless of Petitioners fee status in other proceedings. If the filing fee is not paid or the motion is not filed, the petition may be dismissed without further notice. Petitioner must also file a supplement to the petition advising the Clerk of the underlying district court or lower court information, including the district court action number(s) to which the petition applies. The petition and motion to proceed in forma pauperis must be served on each party to the proceeding in the trial court (or on counsel for each party) and the appropriate district court judge(s). A certificate of service reflecting that the petition and motion have been served must also be submitted to the Court of Appeals within fourteen (14) days of the date of this order. See Rules 21 and 25, Federal Rules of Appellate Procedure. The petition will not be submitted to the Court until the filing fee or motion to proceed in forma pauperis and affidavit and the certificate of service are received.
