October 29, 2021 Opinion or Order Filing 3 ORDER (Clerk) It is noted that portions of this case are sealed in the District Court, including some of the District Court memorandum opinions and order, and numerous exhibits. When the District Court seals part or all of the documents in a civil case, the documents remain under seal in this Court for 30 days after the filing of the notice of appeal to give counsel an opportunity to file a motion to continue the impoundment. See 3d Cir. L.A.R. Misc. 106.1(c)(2). The motion must explain the basis for sealing and specify the desired duration of the sealing order. See id. If the motion does not specify a date, the documents will be unsealed, without notice to the parties, within five years after the conclusion of the case. The parties should refrain from requesting sealing of an entire document and should consider filing a separate sealed supplemental document of redacted versions of the documents. See 3d Cir. L.A.R. Misc. 106.1(a). In the event it becomes necessary to submit the documents in question to the Court prior to the disposition of the motion to seal, those documents must be submitted separately, and the Court must be apprised that the material is sealed. All parties are directed to use the CM/ECF events preceded by the word SEALED whenever filing any documents which may contain material. All hard copies of documents submitted to this Court should be properly labeled that they are SEALED and provided in a clearly marked envelope.
